Terms & Conditions

By placing an order with Poplicious Sweets, you agree to the following Terms & Conditions.

1. Orders & Payments

Order Confirmation
All orders are confirmed only once a deposit or full payment has been received. Orders must be placed through our official website or approved payment method. Communication via social media or email does not confirm a booking.

Deposits & Final Payments

  • A deposit is required to secure your order and booking date.

  • Full payment must be received at least 2 days prior to collection/delivery date.

  • Failure to complete payment may result in cancellation of your order.

Changes to Orders

  • Changes to flavour, quantity, colour, or design must be requested at least 7 days prior to collection/delivery.

  • Changes are subject to availability and may incur additional charges.

2. Cancellations, Refunds & Consumer Rights

Cancellation Policy

  • Cancellations require a minimum of 7 days’ notice.

  • Deposits are generally non-refundable due to preparation, scheduling, and loss of booking opportunities.

Refunds & Credits

  • Change-of-mind cancellations may not be eligible for a refund.

  • At our discretion, a store credit or rescheduled date may be offered.

Important Notice (Australian Consumer Law)
Nothing in these Terms & Conditions excludes, restricts, or modifies your rights under the Australian Consumer Law.

You are entitled to a replacement, refund, or remedy if a product:

  • Is not of acceptable quality,

  • Is not as described, or

  • Does not meet a guarantee that cannot be excluded under law.

Where a failure is major, you are entitled to a refund or replacement.
Where a failure is minor, we may offer to fix or replace the product within a reasonable time.

Force Majeure (Unforeseen Circumstances)

  • In circumstances beyond our control (e.g. natural disasters, illness, government restrictions), we will work with you to offer a rescheduled date, credit, or alternative solution, in line with Australian Consumer Law.

3. Delivery & Collection

Delivery Conditions

  • A responsible person must be present to receive the order.

  • If delivery cannot be completed due to customer absence, additional delivery fees may apply.

Customer Responsibility

  • Customers must provide accurate delivery and contact details.

  • We are not responsible for issues arising from incorrect information provided.

Transfer of Responsibility

  • Responsibility for the cake pops passes to the customer once they have been collected or successfully delivered.

  • This does not affect your rights under Australian Consumer Law.

4. Product Care & Allergen Disclaimer

Allergens

  • Our kitchen handles common allergens including nuts, dairy, gluten, soy, and eggs.

  • While care is taken, we cannot guarantee an allergen-free environment.

  • Customers are responsible for informing guests.

Storage & Handling

  • Cake pops should be stored as advised (e.g. in a cool, dry place or refrigerated depending on ingredients).

  • Poplicious Sweets is not responsible for damage, melting, or spoilage due to incorrect storage or handling after collection/delivery, except where required under law.

Non-Edible Items

  • Cake pops may contain sticks or decorative elements that are not edible.

5. Design & Custom Orders

Handmade Products

  • All cake pops are handmade and may have slight variations in colour, finish, or decoration.

  • Reference images are used as a guide only.

Custom Orders

  • We will make reasonable efforts to match agreed designs, colours, and themes, in line with consumer guarantees.

6. Large Event & Bulk Orders

This clause applies to large orders (e.g. weddings, corporate events, parties, or bulk quantities).

  • A higher deposit may be required to secure large event bookings.

  • Final numbers and full payment are typically required 7–14 days prior to the event date (exact timing will be confirmed at booking).

  • Once this deadline has passed, reductions in quantity or cancellations may not be possible due to preparation and ingredient sourcing.

Changes & Availability

  • Any changes after the agreed deadline are not guaranteed and may incur additional costs.

Event Responsibility

  • It is the customer’s responsibility to ensure proper storage and handling at the event venue (including protection from heat, sunlight, and humidity).

  • We are not liable for damage once the order has been delivered or collected, except as required under Australian Consumer Law.

Delivery Timing

  • While we aim to meet agreed delivery windows, delays caused by factors outside our control (traffic, venue access, weather) may occur. We will take reasonable steps to communicate and minimise disruption.

7. Photography & Intellectual Property

Photo Use

  • We reserve the right to photograph our products and use images for marketing, social media, and promotional purposes.

Ownership

  • All website content, branding, and images remain the property of Poplicious Sweets and may not be used without permission.

8. Website Use

You agree not to use our website or services for unlawful, harmful, or inappropriate purposes.

9. Agreement

By placing an order with Poplicious Sweets, you confirm that you have read, understood, and agree to these Terms & Conditions.
